We have met some clients who come to us with land titles of Land Purchased years ago but just decided to postpone the transfer into their names;
Most of the time, this is because these people do not know the risk of just keeping the Untransferred documents.
Well, bellow are some of the risks/problems you are likely to face if you keep your Land documents untransferred for so long;
1. You Could lose the documents somehow and getting them replaced or redone might not be that easy. Sometimes the sellers just refuse to sign afresh without asking for more money. Some sellers don’t even ask for more money but just want to be difficult. Some people are simply crooks and can just deny the transaction all together. I have encountered all the above scenarios.
2. The documents may get destroyed somehow, by fire, water, pests or your children
3. The laws could change and introduce new requirements for transferring your land. We have met clients who bought land in 2015 when a national identification was not a mandatory requirement for transferring Land Titles. Imagine the trouble one would go through to get the person who sold to them God forbid if they passed away or left the country.
4. Your Land Title could get stolen and fraudulently transferred. And if you do not have possession or if you do not live on the untransferred land, you could loose your land to a bonafide purchaser for value.
Note;
If the person who sold to you dies before you transfer, you have to deal with an administrator of the estate who might not only be uncooperative but the process of appointing administrators also takes time! So do you want to go through all this trouble?
Always have your lawyers transfer your land into your names at the soonest to avoid the above risks and more!
